5. SMS and Text Messaging

If you provide your phone number through one of our forms, opt-in keywords, or by direct request, you may receive text messages from TMS+. Our SMS practices are designed to comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable carrier and industry guidelines.

5.1 Consent

By providing your mobile phone number and opting in, you consent to receive text messages from TMS+ at the number provided. Message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.

5.2 Types of Messages

  • Transactional messages, such as appointment confirmations, reminders, and service updates
  • Conversational replies from team members
  • Marketing messages, where you have separately opted in

5.3 Opting Out

You can opt out of marketing or transactional SMS messages at any time by replying STOP to any message you receive from us. You will receive a confirmation message and will no longer receive SMS communications from that campaign. To resubscribe, reply START. For help, reply HELP or contact us using the information at the end of this policy.

5.4 Mobile Information Sharing

No mobile information collected through SMS opt-in (including phone numbers and opt-in status) will be shared with third parties or affiliates for marketing or promotional purposes. Information may be shared with service providers (such as our SMS gateway and CRM platform) only as necessary to deliver the messages you have requested.

6. Call Tracking and Call Recording

TMS+ may use call tracking numbers to measure the performance of our marketing and to route calls appropriately. When you call a tracked number, we may collect your phone number, the call source, the date and time, and the duration of the call.

Some calls to or from TMS+ may be recorded for quality assurance, training, dispute resolution, and record-keeping purposes. Where required by law, you will hear an audible notice or be otherwise informed at the start of the call. By continuing the call after such notice, you consent to the recording. If you do not wish to be recorded, please notify the team member on the call and they will end the recording or continue the conversation by another method.

7. Cookies, Analytics, and Tracking Technologies

Our website uses cookies, pixels, tags, local storage, and similar technologies to operate the site, remember your preferences, understand website traffic, and support our advertising. You can control cookies through your browser settings. Disabling cookies may affect certain website features.

7.1 Google Analytics

We use Google Analytics to understand how visitors use our website. Google Analytics may collect your IP address, device type, browser type, pages viewed, and time spent on our site. You can opt out of Google Analytics by installing the Google Analytics Opt-Out Browser Add-on.

7.2 Google Ads and Remarketing

We use Google Ads, including remarketing features, to advertise our services online. These tools use cookies and similar technologies to show ads to people who have previously visited our website or engaged with our content. You can manage your Google ad preferences at adssettings.google.com.

7.3 Meta (Facebook and Instagram) Advertising

We use Meta advertising tools, including the Meta Pixel and Conversions API, to understand how visitors interact with our website and to show relevant ads on Facebook and Instagram. 7.4 GoHighLevel Tracking

Pages, forms, and chat widgets delivered through GoHighLevel may set cookies and collect engagement data (such as form interactions, page views, and chat session details) to attribute leads, automate follow-up, and measure campaign performance.

8. Information Sharing

TMS+ Digital Marketing does not sell or rent your personal information. We share information only in the limited circumstances described below:

8.1 Service Providers

We share information with vendors and service providers who perform services on our behalf, including GoHighLevel (CRM, SMS, email, chat, forms, call tracking), website hosting providers, email service providers, analytics and advertising platforms, payment processors, and professional advisors. These providers are permitted to use your information only as necessary to provide services to us.

8.2 Legal Requirements

We may disclose information if required to do so by law, subpoena, court order, or government request, or where we believe in good faith that disclosure is necessary to protect our rights, your safety or the safety of others, investigate fraud, or respond to a government request.

8.3 Business Transfers

If TMS+ is involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any change in ownership or use of your personal information.

8.4 With Your Consent

We may share your information for any other purpose with your consent.

9. Data Retention

We retain personal information for as long as needed to respond to inquiries, provide services, maintain business records, comply with legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or anonymize it.

10. Data Security

No method of transmission over the internet or electronic storage is completely secure, however, and we cannot guarantee absolute security. You are responsible for keeping any passwords or account credentials confidential.
